OAKLAND — A Sacramento man avoided jail time, but received probation and a lifetime sex offender registration requirement, for sending “harmful material” to an undercover officer posing as a teen girl, court records show.

Tyler Montgomery, 30, pleaded no contest in April to sending harmful material to a minor, a felony, with the understanding he’d be sentenced to probation. Montgomery was charged in 2022 with arranging to meet a minor for sex after he allegedly talked to an undercover Oakland officer posing as “Chely,” a 16-year-old girl from the area.

According to police testimony at Montgomery’s preliminary hearing, he discussed wanting to have sex with the girl and how they could stop using condoms “once STD tests were taken.” A police report says Montgomery sent the undercover officer two pictures of his penis.

Montgomery was arrested in October 2022 after he arrived at Lake Merritt for a pre-arranged meetup with the girl. During the undercover operation, police even used a woman in the department’s Child Exploitation Unit talk to Montgomery on the phone while posing as the girl, according to court records.

The sentence was finalized May 15, court records show.
